1.What HaveCreator is

HaveCreator is an online marketplace where brands find and hire content creators in India. Creators list their social accounts, prices and service packages; brands message creators, post requests that creators can bid on, and agree deals with them in chat. We run the platform, hold the brand's payment for each deal until the results are confirmed, pay creators, and help settle disagreements. We are not a party to the creative work: each deal is an agreement between the brand and the creator.

2.Your account

  • You must be at least 18 years old and able to enter a binding contract under Indian law.
  • Each account is either a creator or a brand account. You choose at sign-up and can't change it later; to use HaveCreator in the other role, sign up again with a different email.
  • You sign in with a one-time code sent to your email, a code sent to your Indian mobile number by WhatsApp or SMS, or with Google where it's offered. Keep your email, phone and Google account secure: you're responsible for what happens on your account.
  • What you tell us (names, company details, social accounts, follower counts, prices) must be true and kept up to date.

3.Creators

  • Creators are asked to verify a mobile number. We use it for sign-in, verification and safety, and never show it to brands or the public.
  • List only social accounts you own or are authorised to manage. Follower counts, prices and samples must be accurate.
  • The red verified star means our team has checked your phone and proof that each listed account is yours. If you change an account's follower numbers, that account has to be proven again.
  • Follow the law and the Advertising Standards Council of India (ASCI) guidelines for influencer advertising, including labelling paid content clearly (for example #ad or #sponsored) and not making claims about a product that you can't back up.
  • You're responsible for your own income tax and GST on what you earn.
  • Published creators get a @havecreator.com email address for brand enquiries. It can only reply to emails you receive, up to 20 a day, and these terms apply to it.

4.Brands

  • Your products, services and briefs must be lawful and must not ask a creator to mislead their audience or break ASCI guidelines.
  • Company details (name, website, GSTIN if you add it) must be accurate. Creators see your company name and logo when you message them.
  • Requests: you can post a request for creators in up to three niches. Creators in those niches can see it and bid with a price, a delivery time and a short pitch; each bid is seen only by you and that creator. Requests close after 14 days, and you can shortlist, decline or hire. Hiring opens a chat, and the deal then works as in section 6.

5.How deals work

  • Offer. Either side can send an offer in chat: what's included, the platform, and a flat fee, a price per 1,000 views, or both. Every per-views offer has a budget limit, the most the brand can pay for that deal, and says when views are counted (7, 14 or 30 days after posting). An offer can carry a date to post by. A new offer replaces one that is still waiting for an answer.
  • Acceptance. When the other side accepts, the terms are locked and the deal binds both of you. Until then the sender can withdraw the offer and the other side can decline it.
  • Payment. The brand then pays the deal amount (the flat fee, or the budget limit for per-views deals) plus HaveCreator's brand fee, the GST on it and the payment charge, through one of our payment partners. HaveCreator holds the deal amount until the deal ends. The creator should start only once the deal shows as funded.
  • Results. After posting, the creator submits the post link, the view count and a screenshot of the post's insights. The amount owed is worked out from the agreed terms.
  • Confirmation. The brand confirms the results or disputes them with a reason. When the deal settles, the creator is paid the amount owed minus the creator fee and the GST on it, and any part of the held amount not used is refunded to the brand.

6.Fees

Joining, listing, browsing, chatting and posting requests are free. We charge only on deals that are paid for: a fixed fee to the brand per deal and a percentage of the creator's payout. GST at the applicable rate is charged on both of these fees. The brand also pays the payment partner's charge for processing the payment. The current fees are on our pricing page, and every amount is shown before you pay or accept.

We may change our fees. The fees and GST rate in force when the brand first goes to pay for a deal apply to that deal until it ends.

7.Payments and payouts

  • Brands pay through our payment partners (Razorpay or PayU). We never see or store your card, UPI PIN or net-banking details.
  • Creators add a UPI ID or bank account in their dashboard. When a deal settles, our team sends the payout there and you get a notification with the transaction reference. Keep these details correct: we're not responsible for a payout sent to details you gave us.
  • Deals agreed on HaveCreator must be paid through HaveCreator. We can't protect, and aren't responsible for, money paid outside the platform, and asking someone to pay outside it breaks these terms.
  • Refunds and cancellations follow our Refund & Cancellation Policy.

8.Disputes between brands and creators

If a brand disputes a creator's results, the money stays held. A HaveCreator admin reviews the post, the insights screenshot and the conversation, decides the verified view count, and the deal is settled on the agreed terms. We may also cancel a paid deal and refund the brand where the work wasn't delivered or the deal can't go ahead. Our decision settles the payment on HaveCreator; it doesn't take away any rights you have under the law.

9.Content and intellectual property

  • Creators keep ownership of the content they make. What a brand may do with it beyond the creator's own post (for example reposting, using it in ads, or how long the post stays up) must be agreed between the brand and the creator. Write it in the offer's "what's included" or in the chat so it's on record. If nothing is agreed, the deal is for the post on the creator's own account only.
  • You give us permission to store, show and copy what you add to HaveCreator (profile, photos, services, requests, reviews, links) as needed to run the service and show your listing to others. You must have the rights to everything you upload.
  • The HaveCreator name, logo and website belong to us.

10.Reviews

  • After a deal is completed, the brand and the creator can each review the other once, within 14 days: a star rating, three short ratings and an optional comment. You can also add a private note that only HaveCreator sees.
  • Reviews can't be edited. A review stays hidden until both sides have reviewed or the 14 days are up, so nobody rates in return.
  • Reviews must be honest and about that deal. The person reviewed can report a review as unfair; an admin then keeps or removes it and both sides are told.

11.What's not allowed

  • Harassing, threatening, abusing or spamming anyone, or impersonating a person, a brand or HaveCreator.
  • Fake accounts, fake followers or views, fake reviews, or false results.
  • Content that is illegal, sexually explicit, hateful, or that infringes someone else's rights, and anything else not allowed under the Information Technology Act, 2000 and its rules.
  • Promoting illegal or banned products and services, or misleading advertising.
  • Asking for or making payments outside HaveCreator for a deal found here.
  • Trying to break, overload, scrape or get around the security or limits of the service.

To keep things fair we limit how often you can send messages, offers, bids, reports and uploads. You can block anyone: blocking stops messages and new offers both ways, and deals already agreed can still be finished. You can report a conversation from the chat, and a review from the review.

12.Your messages and data

Our Privacy Policy explains what we collect and why. Our team reads the messages in a conversation only to handle a report, a dispute or a support request, to prevent fraud, or when the law requires it, and every time they do, the access and its reason are recorded.

13.Suspension and closing accounts

We may suspend a listing or a service, remove content or reviews, or ban an account that breaks these terms or the law or puts others at risk. A banned account is signed out everywhere and can't sign in again. We record the reason, and where we can we'll tell you why; a suspended listing's owner is notified. Money held for a deal is still paid out or refunded under these terms.

You can ask us to close your account at any time through HaveCreator Support in your inbox or by email (see Contact us). After that, your messages and reviews show as from a "Deleted account".

14.Our responsibility

We work hard to keep HaveCreator running and secure, but we provide it "as is". We don't guarantee results from any deal (for example views or sales), and we're not responsible for what users post or agree among themselves. To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited under Indian law.

15.Law and courts

These terms are governed by the laws of India. Subject to that, courts at Mumbai have jurisdiction over any dispute about them.

16.Grievance Officer

Under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you can raise a complaint about HaveCreator or any content on it with our Grievance Officer, at havecreator@gmail.com. We acknowledge complaints within 24 hours and resolve them within 15 days. The details are on our Contact page.

17.Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app before it takes effect. Using HaveCreator after that means you accept the updated terms.
